CONSERVATIONIST AWARDED OUT-OF-CLASS PAY
Over the next year, in the extended absence of the Conservation Supervisor, Moreno performed the duties, and then some, of the former CII, including the oversight of all Resource Crews. In early May 2004, Moreno discussed the out-of-class issue with her supervisor, but was told there were no funds to pay her. She was instructed to continue to work as the “Administrative Conservationist.”
In late May 2004, Moreno contacted CAUSE Legal and I filed a formal grievance under §15.2B of the Memorandum of Understanding. Over the next several months the grievance was denied and moved to the next levels in the grievance process. Finally on August 16, 2004, District Director Melvin H. Kreb reconsidered his previous denial at Level II and granted Moreno’s grievance. Under the terms of the MOU, Moreno will be entitled to 12 months back pay from the date the grievance was filed to the date it was granted.
