SPB DENIES CHP'S PETITION FOR REHEARING

In the last issue of the Frontline Linda Kelly reported the favorable decision of the State Personnel Board which ordered CHP to reinstate a public safety dispatcher assigned to the Los Angeles Communications Center. Subsequent to the issuance of the decision CHP filed a petition for rehearing, apparently to prolong the requirement it reinstate the dispatcher and make reimbursement of back pay and benefits. Today CAUSE received notification that on September 2, 2004 the SPB summarily denied CHP's petition. CHP will now be obligated to promptly reinstate the dispatcher or seek a stay of the administrative decision pending appeal. Given the limited standard of review it is CAUSE Legal's opinion CHP will be unsuccessful in its attempts to delay the inevitable. CAUSE Legal will continue its fight to get this member back to her position at LACC.
