CAUSE Site Representative's Adverse Action Set Aside

DMV LRE's Punshment Reduced from Salary Reduction to Reprimand

On August 8, 2005 the Department of Motor Vehicles (DMV) issued a Notive of Adverse Action (NOAA) to Oscar Cueto, a Licensing Registration Examiner in the Fullerton Field Office. Mr. Cueto is also a veteran Site Representative for CAUSE.

The NOAA proposed that Mr. Cueto's salary be reduced by ten percent (10%) for a period of twelve (12) months based on allegations of insubordination, discourtesy, wilful disobedience, and conduct unbecoming. The NOAA cited six (6) incidents spanning a period of eighteen (18) months.

On August 16, 2005 a pre-disciplinary, i.e. Skelly, hearing was conducted. During the hearing I was able to convince the Skelly Officer most of the allegations were frivolous and brought in retaliation for Mr. Cueto's activities as a representative of CAUSE. As a result of my arguments, DMV agreed to modify the salary reduction to a letter of reprimand to be pulled from Mr. Cueto's personnel file one (1) year from the date of issuance.

This is just one more example of why it pays to be a member of CAUSE.
