Skelly Officer Convinced Conduct Justifies Letter of Reprimand
The Adverse Action proposed that Ms. Call-Jacques’ salary be reduced by ten percent (10%) for a period of three (3) months based on allegations of insubordination, inexcusable neglect of duty, and other failure of good behavior. The Action cited a single incident where Ms. Call-Jacques failed to adhere to requests by her supervisor to write a violation to an owner of a cattle ranch because two stray cattle were shipped out of state. Ms. Call-Jacques did not feel a violation was justified because the strays were shipped accidentally and many people played a role in their shipment. Once the mistake was discovered, Ms. Call-Jacques quickly and easily resolved the issue so that all parties were compensated and she sincerely believed that no one was at fault.
On August 25, 2005 a pre-disciplinary, i.e. Skelly hearing was conducted. During the hearing I reassured the Skelly Officer that Ms. Call-Jacques had a perfect personnel record, and that the Adverse Action had arisen from an incident that was a mere misunderstanding. Ms. Call-Jacques advised the Skelly Officer she believed she had taken the best course of action in dealing with the incident and felt that she had resolved it the best way possible.
As a result of the arguments we presented at the hearing, the Department agreed to modify the salary reduction to a letter of reprimand. Ms. Call-Jacques was very satisfied with the result CAUSE Legal was able to achieve on her behalf.
