Department of Personnel Administration Declines to Seek Supreme Court Review of Safety Retirement Dispute
Arbitrator Will Decide Whether Benefit Applies to Prior Service
DPA did not file a petition for review and the appellate court decision is now final. The Law Firm of Carroll, Burdick & McDonough is initiating the arbitrator selection and scheduling process. A copy of a May 21, 2007 letter from CB&M to DPA requesting contact to discuss arbitrator selection is attached at the below link.
The scheduling of the arbitration will be contingent on the availability of the arbitrator. Good arbitrators are in demand and it is not uncommon for proceedings to be scheduled three to six months out. The arbitration will likely take several days over a number of weeks and the parties will submit post-hearing briefs. The arbitrator will then have thirty days from receipt of the closing briefs (unless the parties grant an extension of time) in which to render a decision. Arbitration decisions are generally binding on the parties and not subject to appeal unless the arbitrator acts in excess of his or her authority.
Once an arbitrator is selected and dates are secured, the CSLEA home page will again be updated.
