CSLEA Convinces Department of Mental Health to Rescind Rejection on Probation

Hospital Police Officer Retains Position at Coalinga State Hospital

Recently, a Hospital Police Officer (HPO) at Coalinga State Hospital (CSH), was served a "Notice of Rejection During Probationary Period" (Notice of Rejection). The Notice of Rejection was based on issues that arose during the HPO’s background investigation for hire with the Department of Mental Health (DMH). Although the HPO was new to State service and had only been a Bargaining Unit 7 employee for a couple of months, he had already become a full member of CSLEA.

As a CSLEA member, the HPO was entitled to legal representation by the CSLEA Legal Division in all facets of the disciplinary process, including a rejection on probation. On July 18, 2007, I represented the HPO at a pre-separation meeting. The HPO and I were able to convince the hearing officer, the allegations in the Notice of Rejection were without merit and he agreed to immediately rescind the rejection. The HPO was restored to full duty and will be in a position to successfully complete the remainder of his probationary period.

This case demonstrates that It is never too soon to become a full member of CSLEA. and CSLEA strongly encourages all Bargaining Unit 7 employees to become full members immediately upon hire, because a probationary employee can be rejected at any time. Having a Legal Division to assist in your appeal of a Notice of Rejection, or any other disciplinary action, is one of the many benefits of becoming a full member of CSLEA.
